Please read these Terms carefully before using Itinera. By accessing or using our Service, you agree to be bound by these Terms.

1. Agreement to Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User", "you") and Itinera Technology Private Limited ("Itinera", "we", "us"), a company incorporated under the laws of India.

By creating an account, accessing, or using the Itinera platform at itinera.in or any associated mobile application (collectively, the "Service"), you agree to be legally bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

If you are using the Service on behalf of a business or legal entity, you represent that you have the authority to bind that entity to these Terms.

2. Description of Service

Itinera is an AI-powered travel planning Software-as-a-Service (SaaS) platform that provides:

  • AI-generated, day-by-day travel itineraries personalised to your preferences, budget, and travel dates
  • Interactive maps displaying places, hotels, and routes relevant to your itinerary
  • Trekking route information, hotel discovery, and travel resource guides
  • Collaborative trip planning — invite friends, manage group expenses, and group chat
  • PDF export of your itineraries for offline use
  • Subscription-based premium features including unlimited itinerary generation, advanced maps, and AI day regeneration

Important: Itinera is a planning and discovery tool, not a licensed travel agency, tour operator, hotel, or airline. We facilitate planning; we do not operate any travel services directly.

3. Eligibility

To use the Service, you must:

  • Be at least 13 years of age (or 16 in the EU)
  • Have the legal capacity to enter into a binding contract under applicable law
  • Not be a person barred from receiving services under the laws of India or any other applicable jurisdiction
  • Not have a previously terminated Itinera account due to a Terms violation

By using the Service, you represent and warrant that you meet all eligibility requirements. If you are using the Service on behalf of a minor, you accept responsibility for their use.

4. Account Registration & Security

To access most features of the Service, you must create an account by providing accurate, complete, and current information. You agree to:

  • Maintain the confidentiality of your account credentials (email and password)
  • Not share your account with any third party
  • Immediately notify us at security@itinera.in upon discovering any unauthorised use of your account
  • Ensure that all information you provide is truthful, accurate, and up to date
  • Use a strong, unique password that is not used on any other platform

Itinera will not be liable for any loss or damage arising from your failure to protect your account credentials. You are solely responsible for all activity that occurs under your account.

5. Subscriptions & Billing

5.1 Subscription Plans

Itinera offers three subscription tiers:

Free

Limited itinerary generation, basic map access, 1 AI day regeneration on your first itinerary, and collaboration on your first trip. No payment required.

Explorer

Up to 10 saved itineraries, interactive maps for all trips, 3 AI day regenerations per day, PDF export, and trip sharing. Billed monthly or annually.

Pro

Unlimited itinerary generation, unlimited AI day regenerations, Google Directions routing, full place details, refinement chat, and multi-city planning. Billed monthly or annually.

5.2 Payment

All payments are processed in Indian Rupees (INR) via Razorpay. By providing payment information, you authorise Itinera to charge your selected payment method for the applicable subscription fee.

5.3 Automatic Renewal

Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You will receive a renewal reminder email at least 3 days before your billing date. To cancel, go to Dashboard → Settings → Subscription → Cancel Plan.

5.4 Price Changes

We reserve the right to change subscription prices. We will provide at least 30 days' advance notice via email before any price change takes effect. Your continued subscription after the effective date constitutes acceptance of the new price.

6. Free Tier Limitations

The free tier is provided as a genuine, functional product with the following limitations:

  • Maximum of 3 saved itineraries
  • 1 AI day regeneration on your first itinerary only
  • Interactive map access on your first itinerary (up to 5 place markers)
  • Collaborative trip group on your first itinerary only
  • No PDF export, advanced maps, or AI refinement chat
  • Google AdSense advertisements may be displayed on free-tier pages to support the free plan

Free tier features may change over time. We will communicate material reductions to free-tier capabilities at least 14 days in advance.

7. Refund Policy

7-Day Money-Back Guarantee

If you are not satisfied with your paid subscription, you may request a full refund within 7 calendar days of your initial payment. No questions asked.

How to Request a Refund

  1. Email support@itinera.in with the subject line "Refund Request"
  2. Include your registered email address and Razorpay payment ID
  3. Refunds are processed within 5–7 business days to your original payment method

Exceptions

  • Refunds are not available after the 7-day window (unless required by applicable law)
  • Accounts terminated for Terms violations are not eligible for refunds
  • Annual plan upgrades are refunded on a pro-rata basis for unused months within the 7-day window

8. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law or regulation, including export control or data protection laws
  • Attempt to reverse-engineer, decompile, or extract the source code of any part of the Service
  • Use automated bots, scrapers, or crawlers to extract data from the Service without express written permission
  • Circumvent subscription limits or access paid features without payment
  • Upload or transmit viruses, malware, or any other malicious code
  • Impersonate another person or entity, or misrepresent your affiliation
  • Engage in any activity that could disable, overburden, or impair our servers or infrastructure
  • Harass, threaten, or abuse other users within collaborative features (group chat, shared trips)
  • Generate itineraries for the purpose of commercial resale without an active API partnership agreement
  • Use the Service for any purpose that is fraudulent, deceptive, or harmful

Violations may result in immediate account suspension or termination, without refund, and may be reported to law enforcement where required.

9. AI-Generated Content

Itinera uses large language model (LLM) technology to generate travel itineraries. You acknowledge and agree that:

  • AI-generated itineraries are suggestions, not guarantees. Operating hours, prices, availability, routes, and local conditions change frequently. Always verify critical details directly with venues, transport operators, and accommodation providers before travel.
  • We do not guarantee accuracy. While we strive for high-quality outputs, AI can produce errors, outdated information, or hallucinated details. Use your judgement.
  • Itinerary ownership: AI-generated itineraries you save belong to you for personal use. Itinera retains no intellectual property claim over the specific content of your generated itineraries.
  • No personal advice: Nothing in any itinerary constitutes professional travel, medical, legal, or safety advice. Consult appropriate professionals before undertaking challenging treks or travel to high-risk areas.

10. Third-Party Services

The Service may display links to or information from third-party hotels, airlines, booking platforms, and travel services. Itinera:

  • Does not guarantee the availability, pricing, or quality of any third-party service
  • Is not responsible for the content, policies, or practices of any third-party website
  • Receives no commission from hotels or airlines displayed in AI-generated itineraries unless explicitly marked as a sponsored result
  • Encourages you to read the terms and cancellation policies of any third-party provider before booking

Any transaction between you and a third-party provider is solely between you and that provider. Itinera is not a party to such transactions and accepts no liability arising from them.

11. Intellectual Property

All technology, software, source code, algorithms, design, branding, trademarks, logos, and non-user-generated content comprising the Service are the exclusive property of Itinera Technology Private Limited and are protected by Indian and international intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable licence to use the Service solely for personal, non-commercial travel planning purposes, subject to these Terms.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or commercially exploit any part of the Service without our prior written consent.

12. User Content

You retain ownership of all content you create or upload to the Service ("User Content"), including trip notes, custom itinerary edits, profile information, and group chat messages.

By posting User Content to the Service, you grant Itinera a limited, royalty-free, worldwide licence to store, display, and transmit your User Content solely as necessary to operate the Service. This licence does not permit us to sell, licence, or commercially exploit your User Content.

You are solely responsible for the legality and accuracy of User Content you post. You agree not to post content that is defamatory, infringing, obscene, or otherwise unlawful.

13. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By agreeing to these Terms, you also consent to the collection, use, and disclosure of your personal data as described in the Privacy Policy.

14. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ITINERA EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING:

  • The merchantability or fitness of the Service for any particular purpose
  • The accuracy, reliability, or completeness of AI-generated itinerary content
  • That the Service will be uninterrupted, error-free, or free of viruses
  • That defects in the Service will be corrected within any particular timeframe
  • The suitability of any travel destination described in the Service for any individual

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ITINERA AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, goodwill, or other intangible losses
  • Personal injury, property damage, or death arising from travel activities referenced in AI-generated itineraries
  • Losses arising from third-party service failures (airlines, hotels, booking platforms)
  • Any damage or harm caused by relying on inaccurate AI-generated information

IN ALL CASES, ITINERA'S TOTAL CUMULATIVE LIABILITY TO YOU SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO ITINERA IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) INR 5,000 (FIVE THOUSAND RUPEES).

Some jurisdictions do not allow limitation of liability for certain types of damages. In such jurisdictions, the limitation shall apply to the fullest extent permitted by law.

16. Indemnification

You agree to indemnify, defend, and hold harmless Itinera Technology Private Limited and its officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of or access to the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any User Content you post or transmit through the Service.

17. Dispute Resolution

17.1 Informal Resolution

Before filing any formal claim, you agree to first attempt to resolve the dispute informally by contacting us at support@itinera.in. We will attempt to resolve the dispute within 30 days.

17.2 Arbitration

If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be finally resolved by binding arbitration in accordance with the Arbitration and Conciliation Act, 1996 (India). The arbitration shall be conducted in English, in Chandigarh, India, before a single arbitrator mutually agreed upon by both parties.

17.3 Class Action Waiver

You waive any right to bring a class action or representative proceeding against Itinera. All claims must be brought on an individual basis.

18. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of India, without regard to conflict-of-law principles. Subject to the arbitration clause above, the courts of Chandigarh, India shall have exclusive jurisdiction over any dispute not resolved by arbitration.

19. Termination

19.1 Termination by You

You may terminate your account at any time by going to Dashboard → Settings → Danger Zone → Delete Account. Cancelling your account stops future billing but does not entitle you to a refund outside the 7-day refund window.

19.2 Termination by Itinera

We reserve the right to suspend or terminate your account at our sole discretion, with or without notice, if we determine that you have violated these Terms, engaged in fraudulent activity, or pose a risk to other users or the platform. In such cases, no refund will be issued.

19.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive (including Sections 11, 14, 15, 16, 17, and 18) will survive termination.

20. Modifications to Terms

We may revise these Terms at any time. When we make material changes, we will:

  • Update the "Last Updated" date at the top of this page
  • Send an email notification to registered users at least 14 days before the change takes effect
  • Display a prominent notice on the Service for 30 days after a material change

Continued use of the Service after the effective date of revised Terms constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using the Service.
